5.15Allowing Another to Drive or Move an Unregistered Vehicle

A.Statutory Authority

“Every motor vehicle . . . when driven or moved on a street or highway, is subject to the registration and certificate of title provisions of [the MVC] except [as provided in MCL 257.216(1)(a)-(o)[.]” MCL 257.216(1). “Except as otherwise provided in [MCL 257.216(2)], a registration issued to a motor vehicle . . . when driven or moved on a street or highway, that expires on or after March 1, 2020 is valid until March 31, 2021. . . . If the registration issued to a motor vehicle . . . when driven or moved on a street or highway, that is used for commercial purposes expires on or after March 1, 2020, the registration is valid until March 31, 2021.” MCL 257.216(2). “Except as otherwise provided in [MCL 257.216(2)], a registration issued to a motor vehicle . . . when driven or moved on a street or highway, that expires after March 31, 2021 but before August 1, 2021, is valid until 120 days after the date of the expiration.  . . . If the registration issued to a motor vehicle . . . when driven or moved on a street or highway, that is used for commercial purposes expires after March 31, 2021 but before August 1, 2021, the registration is valid until 120 days after the date of the expiration.” Id.

“It is a misdemeanor for . . . an owner knowingly to permit to be driven or moved upon any highway any vehicle of a type required to be registered hereunder which is not registered or for which a certificate of title has not been applied for or for which the appropriate fee has not been paid when and as required hereunder[.]” MCL 257.215.

B.Penalties

MCL 257.901(2) provides the following penalties:

imprisonment for not more than 90 days; or

fine of not more than $100; or

both.
